Terms & Conditions
These terms govern your enrolment in and use of Withaya courses. We have written them as clearly as we can. If you have questions about anything here, please reach out before enrolling.

1. Definitions
Throughout this document, the following terms carry specific meanings:
- "Withaya" / "We" / "Us" / "Our" — Withaya, operating at 56 Chiang Mai-Lampang Road, Mueang, Chiang Mai 50000, Thailand, providing personal budgeting education for adults.
- "Participant" / "You" / "User" — any individual who enrols in, purchases, or attends a Withaya course or accesses this website.
- "Course" / "Service" — any educational programme, workshop, session, or related material offered by Withaya.
- "Content" — all materials, templates, worksheets, session recordings (if provided), written guides, and resources distributed as part of a Course.
- "Agreement" — these Terms & Conditions, together with any supplementary enrolment confirmation or written agreement.
- "Website" — the Withaya website accessible at https://withaya.sbs.
2. Acceptance of Terms
By submitting an enrolment inquiry, making a payment, or attending a Withaya session, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement under Thai law. Participants residing outside Thailand are also subject to these terms when engaging with Withaya services.
If you are enrolling on behalf of another person (for example, a spouse or family member), you confirm that you have the authority to accept these terms on their behalf.
3. Service Description
Withaya offers in-person and online budgeting courses for adults over 40 based in Chiang Mai and the surrounding region. Our courses focus on practical financial planning skills, including budgeting, spending pattern analysis, and long-range financial planning.
Current course offerings include:
- Building Your First Personal Budget — an introductory course covering income tracking, expense categorisation, and budget creation (฿4,200).
- Optimizing Spending and Saving Patterns — for participants with an existing budget who wish to refine their approach (฿9,500).
- Long-Range Financial Planning Through Budgeting — an advanced course extending budgeting into multi-year financial planning (฿16,800).
Course content, format, session dates, and supporting materials are described on our website and in your enrolment confirmation. Withaya reserves the right to update course content to reflect current practices without altering the substantive learning outcomes.
Geographic availability: courses are primarily delivered in Chiang Mai, Thailand. Online delivery may be available for specific sessions; this will be stated clearly in the course description.
4. Enrolment & Accounts
Enrolment is confirmed upon receipt of full payment or a written enrolment agreement from Withaya. Submitting an inquiry does not constitute enrolment.
You are responsible for providing accurate contact and personal information during enrolment. Withaya will use this information to communicate course details, schedule updates, and supporting materials.
Where online portals or shared resources are provided, you are responsible for keeping any access credentials secure and not sharing them with others.
Withaya may decline an enrolment request at its discretion, in which case any payment received will be refunded in full within 14 business days.
5. Participant Responsibilities
Participants are expected to engage with course sessions respectfully and constructively. Withaya courses are designed to be a supportive environment for adults working through personal financial habits.
Acceptable conduct includes: attending sessions punctually, completing preparatory exercises as requested, and engaging in group discussions in good faith.
Prohibited activities include:
- Recording, distributing, or reproducing any course session or material without written permission from Withaya.
- Sharing course content, templates, or worksheets with individuals who are not enrolled participants.
- Using course materials for commercial purposes, resale, or delivery of competing services.
- Conduct that disrupts the learning environment or is disrespectful toward other participants or facilitators.
- Providing false information during enrolment or in communications with Withaya.
Violation of these conduct standards may result in removal from the course without a refund, at Withaya's sole judgement.
6. Intellectual Property
All course materials, templates, worksheets, session outlines, written guides, and website content are the intellectual property of Withaya unless otherwise stated. They are protected under Thai copyright law and applicable international agreements.
Upon enrolment, Withaya grants you a limited, non-exclusive, non-transferable licence to use course materials for your own personal financial planning. This licence does not permit reproduction, distribution, or commercial use.
Materials you create during workshops (for example, your personal budget or financial roadmap) remain your own property. Withaya does not claim any rights over personal financial documents you produce.
The Withaya name, logo, and course titles are proprietary identifiers and may not be used without written permission.
7. Payment Terms
Course fees are quoted and charged in Thai Baht (฿). Full payment is due before the first session unless a written instalment arrangement has been agreed.
Accepted payment methods include Thai bank transfer, PromptPay, and cash (by prior arrangement). Details are provided in your enrolment confirmation.
Refund policy:
- Cancellations made 14 or more days before the first session: full refund, less any processing fees incurred.
- Cancellations made 7–13 days before the first session: 50% refund.
- Cancellations made fewer than 7 days before the first session, or after the course has begun: no refund. We may, at our discretion, offer a credit toward a future course.
- If Withaya cancels or significantly reschedules a course, you will receive a full refund or the option to transfer to an alternative date.
Refund requests should be sent to [email protected]. Processing time is up to 14 business days via the original payment method.
8. Course-Specific Terms
Session attendance: Courses include a defined number of live sessions as described in each course outline. Sessions missed due to personal circumstances cannot typically be rescheduled individually, though Withaya will make reasonable efforts to share notes or recordings (where available) with absent participants.
Coaching sessions (Courses 2 & 3): Individual coaching calls must be scheduled through Withaya and used within 60 days of the final group session. Unused sessions do not carry forward or provide a refund entitlement.
Capstone presentation (Course 3): The three-year financial roadmap capstone is a personal exercise. Participants are not required to share financial details they wish to keep private. Facilitators will provide feedback based on the planning methodology rather than on personal data.
Materials: Printed materials and digital worksheets are provided for personal use during the course. Withaya retains the right to update materials between cohorts.
9. Disclaimers
Withaya courses are educational in nature and are intended to build practical budgeting and planning skills. They do not constitute financial advice, investment advice, tax advice, or legal advice.
Outcomes from applying course material will vary depending on individual circumstances, household structure, income, expenses, and commitment to practice. Withaya makes no representation about specific financial outcomes.
Course content is provided in good faith and reflects broadly accepted personal finance practices. Participants should consider consulting a licensed financial planner for decisions involving significant sums, investments, or complex legal structures.
The website and course materials are provided on an "as available" basis. Withaya does not warrant that the website will be uninterrupted or error-free.
10. Limitation of Liability
To the extent permitted under Thai law, Withaya's total liability to any participant arising from or related to these terms or any course shall not exceed the total course fees paid by that participant for the relevant course.
Withaya shall not be liable for indirect, incidental, consequential, or special damages, including but not limited to loss of income, financial losses from decisions made after applying course material, or loss of data.
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable Thai law.
11. Indemnification
You agree to indemnify and hold Withaya, its facilitators, and staff harmless from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these terms, your misuse of course materials, or your conduct during course sessions.
12. Termination
By you: You may withdraw from a course at any time. Refund eligibility is governed by the cancellation policy in Section 7.
By Withaya: Withaya may remove a participant from a course without refund if the participant engages in conduct that materially disrupts sessions or violates Section 5. We will generally attempt to resolve issues informally before taking this step.
Sections 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Dispute Resolution) survive termination of this Agreement.
13. Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these terms shall first be addressed through informal discussion. If informal resolution is not achieved within 30 days, disputes shall be subject to the jurisdiction of the courts of Chiang Mai Province, Thailand.
Participants who are consumers resident in Thailand retain any rights afforded under the Consumer Protection Act B.E. 2522 (1979) and any subsequent amendments.
14. General Provisions
- Entire Agreement: These terms, together with your enrolment confirmation, constitute the complete agreement between you and Withaya regarding the subject matter herein.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Withaya's failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.
- Assignment: You may not assign your enrolment or rights under these terms to another person without Withaya's written consent. Withaya may transfer its obligations in connection with a business restructure.
- Notices: Formal notices should be sent to [email protected] or by post to our Chiang Mai address.
- Language: These terms are written in English. In the event of a conflict with a translation, the English version prevails.
15. Changes to Terms
Withaya may update these terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practical, notify enrolled participants by email.
Continuing to participate in a course after the effective date of updated terms constitutes acceptance of those changes. If you do not agree with updated terms, please contact us before your next session.
